    Provisions of Standard Public Procurement Documents Amended

          On 20 May 2008, the Director of the Public Procurement Office under the Government of the Republic of Lithuania adopted Order No. 1S-38 “On Amending Order No. 1S-121 of the Director of the Public Procurement Office under the Government of the Republic of Lithuania, dated 31 December 2003 “On Approval of Standard Procurement Documents““ (official gazette Valstybės Žinios, 2008, No. 59-2259) (hereinafter referred to as the “Order“).

           Please note that standard public procurement documents are used in drafting procurement documents, as well as various notices sent by the contracting authority to suppliers. The Order provides for amendments to the following standard public procurement documents:

          (i) Terms of Open Procedure;

          (ii) Terms of Restricted Procedure;

          (iii) Terms of Simplified Open Procedure;

          (iv) Terms of Simplified Restricted Procedure.

          Amendments provided for in the Order are mostly related to data which must be given in tenders: e.g. there is a recommendation to indicate a specific date in the tender until which the tender is valid (paragraph 1.5 of the Order). The Order also discusses in detail certain price fixing criteria, for example, it is noted that the price of the contract the duration of which is more than one year, in case of procurement of work, must be recalculated referring to the total change of the level of prices and, in case of procurement of goods, services or work – also upon changes in taxation (paragraph 1.12 of the Order). The Order also provides for other, more detailed amendments to standard public procurement documents.
