          The primary purpose of this Newsflash is to reflect the most important new regulations and changes in the national legislation related to real estate:

          

          Order No D1-432 of the Minister of Environment of the Republic of Lithuania of 25 May 2010 on the amendment of the Order of the Minister of Environment of the Republic of Lithuania No D1-555 of 22 September 2009 on approval of the Technical Construction Regulation STR 1.09.06:2009 „Suspension of Construction. Elimination of the consequences of unauthorised construction“.

          

          Published in Valstybės Žinios (Official Gazette) No 63-3113 of 31 May 2010, entered into force on 1 July 2010.

          

          Among the other things, by this Order:

          

          • the county governor’s competence in the field of suspension of unauthorised construction and elimination of its consequences has been disposed to the State Territorial Planning and Construction Inspectorate under the Ministry of Environment (hereinafter the “Inspectorate”);

          

          • the definition of the Suspended Construction Inspection Act has been introduced in replacement of the definition of the Construction Inspection Act; • after suspension of construction, the possibility has been provided to carry out construction works necessary to eliminate violations specified in the Construction Suspension Act;

          

          • the provision regulating the time period (10 working days), during which the officer of the Inspectorate had to apply to the court regarding an obligation to comply with the requirements specified in the Construction Suspension Act or Unauthorised Construction Act was abolished, hereinafter this time period is not defined by any specific date;

          

          • it has been established that if an Unauthorised Construction Act has been drawn by the authorised officer of the Inspectorate, the directorate of the protected area where the construction was going on shall be informed within 3 working days after drawing up of such act.

          

          Order No D1-439 of the Minister of Environment of the Republic of Lithuania of 27 May 2010 “On the Approval of Rules of Purchase Procedures of Construction Technical Supervision Services and Construction Contract Works of Renovation (Modernization) of Block of Flats“.

          

          Published in Valstybės Žinios (Official Gazette) No 64-3174 of 3 June 2010, entered into force on 4 June 2010.

          

          The Rules of Purchase Procedures of Construction Technical Supervision Services and Construction Contract Works of Renovation (Modernization) of Multi-apartment houses approved by the Order determines the procedure of purchase performance of construction technical supervision services of renovation (modernization) of multi-apartment house and construction contract works for the renovation (modernization) of multi-apartment house, if the administrator of common use objects is not a purchasing organization under the Law on Public Procurements (hereinafter – the LPP) and it is not subject to the LPP and if procurements are not carried out via the central purchasing organization from the point of view of the LPP.
